General Waiver of Liability and Assumption of Risk (“Release”)

I acknowledge and agree to participate in the event for which I am registering sponsored by the Marfan Foundation (“Foundation”). In consideration for being permitted to participate in the event for which I am registering and in recognition of the Foundation’s reliance thereon, I agree to all terms and conditions set forth in this Release.

I hereby expressly waive and release any and all rights and claims of any nature, now known or hereafter known, whether arising out of ordinary negligence of the Foundation or its directors, officers, employees, agents, chapters, assignees, licensees, volunteers and cooperating entities, their representatives, heirs, executors, administrators, successors, and assigns (collectively, the “Released Parties”) or otherwise, arising out of or resulting from any and all injuries or damages of any nature, including property damage, injury, disability, or death, which I may suffer while taking part in the event for which I am registering or any activities connected with the event for which I am registering. I covenant not to make or bring any such claim against the Foundation or any Released Parties, and forever release and discharge the Foundation and other Released Parties from liability under such claims.

I hereby consent to receive medical treatment deemed necessary if I am injured or require medical attention during my participation in the event for which I am registering. I acknowledge and agree that I am solely responsible for all costs related to such medical treatment and any related medical transportation and/or evacuation. I hereby release, forever discharge, and hold harmless the Foundation and the other Released Parties from any claims based on treatment or medical services.

This Release constitutes the sole and entire agreement of Foundation and me with respect to the subject contained herein and supersedes all prior and contemporaneous understandings, agreement, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Release is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Release or invalidate or render unenforceable such term or provision in any other jurisdiction.

All matters arising out of or relating to the making or performance of this Release shall be governed by the laws of the State of New York, without giving effect to any choice or conflict of law provisions thereof to the extent such principles or rules would require or permit the application of the laws of any jurisdiction other than those of the State of New York. Any claim or cause of action arising under this Release may be brought only in federal and states courts located in Nassau County, New York, and I hereby consent to the exclusive jurisdiction of such courts.
